Title IX Information

​Title IX Compliance
Title IX of the Education Amendments of 1972 (20 U.S.C. 1681–1688) bars discrimination “on the basis of sex” in federally funded education programs. The U.S. Department of Education implements Title IX through regulations found in 34 CFR Part 106, which outline institutional responsibilities, grievance procedures, and protections for students and employees.  
Title IX sexual harassment includes:
  • Quid pro quo harassment — an employee conditioning any school aid, benefit, or service on an individual’s participation in unwelcome sexual conduct.
  • Hostile environment harassment — unwelcome sex-based conduct that a reasonable person would find so severe, pervasive, and objectively offensive that it denies a person equal access to our District education programs or activities.
  • Sexual assault, dating violence, domestic violence, or stalking, as those terms are defined by law.
 
The Title IX Coordinator oversees the School’s response to reports and complaints of sex-based harassment, monitors for barriers to reporting, and ensures compliance with Title IX’s procedural requirements. We have a Title IX Coordinator designated for each of our schools as follows:

Any employee who has knowledge of conduct that reasonably may constitute sex-based harassment — involving a student or an employee, must report it to the Title IX Coordinator, immediately. This obligation applies regardless of the employee’s role and regardless of whether the person affected wants to file a formal complaint. Unlike students, employees may be compelled to participate in a Title IX investigation.
 
A report is simply information about possible sexual harassment shared with any school employee, in any form. A “complaint” is a formal written request that will be investigated.
 
When a formal complaint is filed, the School will:
  • Provide written notice of the allegations to all parties;
  • Assign an unbiased investigator to gather evidence and interview witnesses;
  • Give both parties an opportunity to review the evidence and respond;
  • Prepare a written investigative report, with a further opportunity for both parties to respond;
  • Have a decision-maker (someone other than the investigator or Title IX Coordinator) issue a written determination of responsibility, applying a preponderance-of-the-evidence standard; and
  • Offer both parties the right to appeal.
  • Throughout this process, the respondent is presumed not responsible until a determination is made, both parties may have an advisor present, and the School will offer supportive measures (such as schedule adjustments, counseling referrals, or no-contact directives) as needed regardless of outcome.
  • The complete Title IX Grievance Procedures, including timelines and evidentiary rules, are maintained separately and available from the Title IX Coordinator upon request.
 
TYD strictly prohibits retaliation against anyone for reporting, participating in, or refusing to participate in a Title IX process.
